Consignment Agreement & Terms of Service

This Agreement governs all cards, memorabilia, or related items ("Items") that a consignor ("Consignor," "you") delivers to Troop Troop LLC, d/b/a Sports Card Hustle ("Company," "we," "us"), for the purpose of sale through live auction shows on Whatnot or other platforms the Company may use.

By shipping, dropping off, or otherwise delivering Items to the Company, or by checking the agreement box on our consignment intake form, you agree to be bound by these terms.

1. What This Agreement Covers

This Agreement applies to any Items you consign to the Company for sale. Each consignment is governed by these terms unless the Company and Consignor agree in writing to different terms for a specific consignment.

2. Commission Split

Consignor's share of the Net Sale Price depends on the tier the Item's sale price falls into:

  • Under $50: Consignor receives 60%, Company retains 40%.
  • $50 – $499.99: Consignor receives 75%, Company retains 25%.
  • $500 and up: Consignor receives 85%, Company retains 15%.
  • "Net Sale Price" means the final hammer/sale price paid by the buyer, minus any platform fees charged by Whatnot (or another selling platform) on that transaction. The tier is determined by the Item's final hammer price.

The Company's share compensates the Company for: sourcing buyers and running the live show, pricing and market research, all shipping costs and shipping materials described in Section 3, payment processing coordination, and the Company's own business overhead and tax obligations.

For exceptional collections or bulk submissions that don't fit neatly into the tiers above, the Company may offer customized terms — any such arrangement will be agreed to in writing between the Company and Consignor before the Items are consigned.

3. Shipping Costs & Materials

The Company covers, at its own cost, all shipping and packaging materials required to safely prepare and ship sold Items to buyers, including but not limited to: cardboard, mailers/envelopes, bubble mailers, card savers/card guards, top loaders, and penny sleeves. The Company also covers outbound shipping costs to buyers once an Item sells. Consignor is not billed for any of the above.

4. Getting Items To The Company

Consignor may deliver Items by any of the following methods:

  • Mail: Consignor ships Items to the Company at Consignor's own cost, using tracked and insured shipping. The Company strongly recommends insuring any shipment for its full value, as carriers — not the Company — are responsible for items lost or damaged in transit before the Company receives them.
  • Local pickup: The Company offers free local pickup for Items located within the greater Denver, Colorado metro area.
  • Travel for larger collections: At the Company's sole discretion, the Company may travel outside the Denver metro area at no charge to Consignor to pick up qualifying collections. Whether a collection qualifies (based on estimated size, value, or other factors) is determined by the Company on a case-by-case basis and is not guaranteed for every request.

5. Inspection & Acceptance

The Company will inspect Items upon receipt. Raw (ungraded) cards must be in at least Near Mint (NM) condition to be accepted for consignment, unless the Company agrees in advance to accept a lower-condition item; graded cards are accepted regardless of grade. The Company reserves the right to decline to accept any Item for consignment, including Items it believes are counterfeit, materially misrepresented, or not commercially viable to sell. If the Company determines that most Items in a submission are unlikely to receive bids, it will contact Consignor before declining or returning that submission. If the Company declines an Item, it will notify Consignor and return the Item at Consignor's expense, or hold it for Consignor's own arranged pickup. To maximize sell-through, the Company may combine multiple similar, duplicate, or lower-value Items into a single lot for sale rather than listing them individually, at its discretion.

6. Ownership, Authenticity & Consignor Representations

By consigning an Item, Consignor represents and warrants that:

  • Consignor is the lawful owner of the Item, or is otherwise authorized to consign it for sale, free of any liens, claims, or ownership disputes.
  • The Item is authentic and not counterfeit, altered, or misrepresented in any material way known to Consignor.
  • Consignor has disclosed any known condition issues, alterations, or restoration to the Company prior to consignment.

Consignor agrees to indemnify and hold the Company harmless from any claims, losses, or disputes arising from a breach of these representations.

7. Pricing & Sale

The Company determines the listing and starting price for each Item based on current market data and comparable sales. For higher-value Items, the Company will make reasonable efforts to discuss pricing expectations with Consignor in advance, but the Company retains final discretion over pricing and the manner in which an Item is presented and sold during a live show, in order to run an effective auction.

8. Live Show Conduct

Consignor (and anyone acting on Consignor's behalf) may not bid on, or arrange for any other person to bid on, Consignor's own consigned Items during a live show or any other sale. This is a zero-tolerance policy: if the Company determines Consignor has bid on their own Items, the Company will immediately and permanently stop accepting consignments from Consignor, and may cancel any pending sales or payouts related to the violation.

9. Consignment Period

The initial consignment period for an Item is 120 days from the date the Company receives it. The Company will make commercially reasonable efforts to feature the Item in a show within that window, though exact timing depends on show scheduling and inventory volume.

10. Unsold Items

If an Item has not sold by the end of the consignment period:

  • The Company may, with Consignor's consent, continue to feature it in future shows; or
  • Consignor may request the Item be returned. Return shipping costs are Consignor's responsibility unless the Company agrees otherwise; or
  • For Items of low resale value (generally under $10 in estimated market value), the Company may request Consignor's written permission to donate or responsibly dispose of the Item rather than incur return shipping costs disproportionate to its value.

11. Payment

Once an Item sells, the Company will pay Consignor's share within 10 business days of the applicable show or sale closing, via a mutually agreed method (e.g., Venmo, PayPal, Cash App, or check). The Company will provide a payout summary showing what sold, the sale price, and the amount owed. If Consignor owes the Company any amount under this Agreement (for example, unpaid return shipping, or amounts described in Section 12), the Company may withhold or offset that amount from any future payout owed to Consignor, and may hold any of Consignor's remaining consigned Items as security until the amount owed is paid.

12. Buyer Non-Payment & Returns

Non-Payment: If a buyer wins an Item at auction but fails to complete payment, the Company will make reasonable efforts to collect. If payment is not received within a reasonable time, the Company may relist the Item in a future show. A winning bid alone does not entitle Consignor to payment — Consignor is only paid once an Item actually sells and payment is successfully collected.

Buyer Returns: If a buyer returns a purchased Item consistent with Whatnot's (or another platform's) buyer protection policies, the sale will be reversed and the associated payout deducted from Consignor's balance or future payouts. If the return was caused by Consignor's own inaccurate description of the Item's condition or authenticity, Consignor may also be responsible for a reasonable return handling fee, to be disclosed by the Company at the time.

13. Care & Liability While Items Are In The Company's Possession

The Company will use reasonable care in storing, handling, and shipping consigned Items. However, the Company is not an insurer of the Items and does not guarantee against loss, theft, or damage. The Company's maximum liability for any single Item lost, stolen, or damaged while in its possession is limited to that Item's then-current fair market value, based on recent comparable sales, as reasonably determined by the Company. The Company is not liable for indirect, incidental, or consequential damages of any kind. If an Item is returned to Consignor (whether unsold or withdrawn), Consignor should inspect it promptly and notify the Company of any damage within 5 business days of receipt; after that window, the Company is not responsible for the Item's condition.

14. Grading Services

If Consignor wants an Item professionally graded (e.g., PSA, BGS, SGC) before it is sold, this is a separate service from standard consignment. Grading fees, timelines, and terms will be agreed to in writing between Consignor and the Company before any Item is submitted for grading.

15. Withdrawing Items Early

Consignor may request the return of any unsold Item at any time by providing reasonable written notice. Return shipping costs are Consignor's responsibility. If an Item is already scheduled for an imminent show, the Company may ask Consignor to allow that show to proceed before withdrawing the Item.

16. Taxes

Each party is responsible for its own tax obligations arising from this Agreement. The Company is responsible for taxes owed on its own commission revenue. Consignor is responsible for any taxes owed on their share of sale proceeds. The Company may request a completed Form W-9 from Consignor and may issue tax reporting forms (such as Form 1099-NEC or 1099-K) where required by law. Nothing in this Agreement constitutes tax advice; Consignor should consult their own tax professional regarding their obligations.

17. Independent Relationship

This Agreement does not create an employment, partnership, joint venture, or agency relationship between the Company and Consignor beyond the consignment arrangement described here.

18. Term & Termination

Either party may end future consignment activity at any time. Ending the relationship does not affect Items already sold or payments already owed. Items still held by the Company at the time of termination will be handled under Section 15.

19. Force Majeure

The Company is not liable for delays or failures to perform caused by events outside its reasonable control, including shipping carrier disruptions, platform outages, natural disasters, or other similar events.

20. Limitation of Liability

To the fullest extent permitted by law, the Company's total liability to Consignor under this Agreement, for any cause, will not exceed the total value of the specific Item(s) giving rise to the claim, as determined under Section 13.

21. Governing Law & Disputes

This Agreement is governed by the laws of the State of Colorado, without regard to conflict-of-law principles. The parties agree to first attempt to resolve any dispute informally and in good faith. If a dispute cannot be resolved informally, it will be resolved in the state or small claims courts located in Colorado, or through binding arbitration if both parties agree in writing at the time of the dispute.

22. Entire Agreement

This Agreement, together with any written consignment intake details for a specific Item, is the entire agreement between Consignor and the Company regarding consigned Items, and supersedes any prior discussions on the subject. This Agreement may only be amended in writing, signed by both parties. If any provision is found unenforceable, the remaining provisions remain in full effect.
